  • Indiana, Pennsylvania

We may also serve surrounding communities within a reasonable distance from these primary locations on a case-by-case basis. Service availability in areas outside our primary service locations may be subject to additional considerations including project size, scheduling constraints, and logistical factors.

4. Eligibility & User Responsibilities

To engage our services, you must be at least eighteen (18) years of age and possess the legal authority to enter into binding contracts under applicable law. If you are entering into this agreement on behalf of a business or organization, you represent and warrant that you have the authority to bind that entity to these terms.

Your Responsibilities Include:

You are responsible for providing accurate, complete, and current information when requesting quotes, scheduling appointments, or engaging our services. This includes property addresses, contact information, project details, and any relevant site conditions or access requirements.

You must ensure that we have legal access to the work site and that all necessary permissions, permits, and approvals have been obtained before work begins. You are responsible for identifying and disclosing any underground utilities, property line disputes, easements, or other conditions that may affect our ability to perform the work safely and legally.

You agree to maintain a safe work environment and to keep children, pets, and unauthorized persons away from the work area during project execution. You are responsible for removing or protecting any personal property, vehicles, landscaping, or structures that may be affected by our work.

You must provide accurate information regarding any known hazardous materials, environmental conditions, or historical site uses that could affect worker safety or project execution. You acknowledge that weather conditions, unforeseen site conditions, material availability, and other factors beyond our control may affect project scheduling and completion timelines.

5. Appointment & Scheduling Policies

When you request an appointment for consultation, estimate, or service, we will make reasonable efforts to accommodate your preferred schedule based on our availability and existing commitments. Appointment times are estimates and may be subject to adjustment due to weather conditions, equipment issues, or scheduling changes.

For larger projects requiring specific start dates, we will provide a projected timeline based on current scheduling, weather forecasts, and material availability. Project start dates are estimates and not guaranteed commitments unless explicitly stated in writing.

You agree to provide adequate notice if you need to reschedule an appointment. We ask that you contact us at least twenty-four (24) hours in advance if you need to change or cancel a scheduled appointment.

You are responsible for ensuring that our crew has clear, safe access to the work site on scheduled service dates. This includes ensuring that driveways, gates, and work areas are accessible and that any necessary arrangements with property managers or homeowner associations have been made.

Weather-related delays are common in the construction industry. We reserve the right to postpone or reschedule work when weather conditions would compromise work quality or worker safety. We will make reasonable efforts to notify you promptly of any weather-related schedule changes.

6. Cancellation Policy

We understand that circumstances change and that you may need to cancel or postpone scheduled services. To ensure fairness to all clients and to manage our scheduling efficiently, the following cancellation policies apply:

For consultation appointments and estimates, we request at least twenty-four (24) hours advance notice if you need to cancel or reschedule. For scheduled project work, cancellation notice requirements vary based on project size and scheduling.

If you cancel a project after materials have been ordered specifically for your job, you may be responsible for costs associated with those materials, restocking fees, or cancellation charges from suppliers. We will make reasonable efforts to minimize such costs and will provide documentation of actual expenses incurred.

If a project is cancelled after work has commenced, you are responsible for the value of all work completed up to the point of cancellation, as well as any materials incorporated into the project.

We reserve the right to cancel or refuse service if site conditions are unsafe, if required permits or approvals have not been obtained, if access to the work site is inadequate, or if we determine that we cannot complete the work to our quality standards.

7. Electronic Communications & E-Signature Consent

By using our website, submitting forms, providing your email address, or engaging our services, you affirmatively consent to receive communications from Townsend & Skursky Paving LLC through electronic means.

We are not responsible for work outside the agreed scope. Our work is performed in accordance with industry standards and best practices for the construction and paving industry. However, we cannot guarantee specific performance outcomes that depend on factors outside our control, including weather exposure, usage patterns, soil conditions, drainage, and property maintenance.

Our estimates and proposals are based on observable site conditions at the time of inspection. If unforeseen subsurface conditions, hidden utilities, contaminated soil, unstable base materials, or other latent defects are discovered during project execution, additional work may be required. We will notify you of such conditions and provide recommendations for addressing them.

We are not responsible for damage to underground utilities, structures, or other hidden objects that were not properly located and marked prior to excavation. You are responsible for requesting utility location services from appropriate utility companies before work begins.

Unless specifically included in our written proposal, obtaining necessary permits, approvals, or inspections from governmental authorities or homeowner associations is your responsibility. We will cooperate with inspection processes and make reasonable efforts to perform work in accordance with applicable code requirements.

10. Warranties & General Disclaimers

We stand behind the quality of our work and warrant that services will be performed in a workmanlike manner consistent with industry standards. Any warranty on our workmanship will be specified in your project proposal or contract and will typically cover defects in installation or application for a specified period following project completion.

Warranties on workmanship do not cover damage resulting from property owner negligence, improper maintenance, normal wear and tear, acts of nature, extreme weather events, changes in soil or drainage conditions, or modifications made by others.

Warranties on materials are typically provided by the material manufacturer, not by Townsend & Skursky Paving LLC. We will use commercially reasonable efforts to assist you in pursuing any manufacturer warranties.

EXCEPT AS EXPRESSLY PROVIDED IN A WRITTEN PROJECT CONTRACT, OUR SERVICES AND WEBSITE ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. We do not warrant that our website will be uninterrupted, error-free, or completely secure. We make no warranties regarding the results that may be obtained from use of our services.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TOWNSEND & SKURSKY PAVING LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE OUR SERVICES OR WEBSITE.
